If you’ve been following our series on restaurant insurance then you’ll know that “Big” George Jowlsby is in a pickle. 

In an attempt to hide his assets from the court in anticipation of the lawsuit that has been levied against him, George entrusted his girlfriend Veronica to transfer his liquid assets into her own bank account for safekeeping. In actuality, George’s goal was to hide the money from the insurance company suing him.

In part 24, George learned that Veronica had plans of her own. She disappeared, cancelled her apartment lease, and flew the coop with all of George’s money. We know she flew to South Florida, but George has no idea where she went.

George meets with his civil defense attorney, a lady named Linda. 

Linda explains to George that the first step they need to take is sending an official response, called an answer, to the insurance company’s legal complaint letter stating that George denies any liability for the damage caused by the drunk driving dump truck accident. 

George can barely pay attention. He doesn’t know what will happen now that his girlfriend has run off with nearly all of his money. 

Both out of fear and embarrassment, he hasn’t yet told his attorney about the theft. 

Several days later, both parties involved in the lawsuit meet with the judge, and then the process of discovery begins. 

“During discovery, we and the plaintiff will request evidence from one another, often in the form of documents like records of phone calls, bank statements, or text message transcripts,” Linda explains. 

“What if they ask for something I don’t want to give them?” George asks. 

“Well, that usually depends on what it is they’re asking for,” Linda answers. “Sometimes we can argue that the information being requested is irrelevant to the case. Sometimes we can argue that what they’re requesting is too invasive, such as information you share with your doctor.” 

George just nods. Her answer was not as reassuring as he had hoped it would be. 

A few weeks later, George and Linda receive a number of requests from the Plaintiff’s attorney. 

Most of the information they’re asking for seems harmless enough, George thinks, but then his eyes land on one request in particular: George’s bank account records for the last twelve months.

Not for the last time, George starts to sweat again.
